WHAT ARE THE OBJECTIVES AND GROUNDS FOR PROCESSING PERSONAL DATA?

To provide services in accordance with the scope of our activities, the Personal Data Administrator processes your personal data - for various purposes, but always in accordance with the law.

A.    in order to take action at your request before concluding a contract for the provision of services in accordance with the scope of our business, we process the following personal data:
Name and surname, company name, registered office, correspondence address, e-mail address, telephone number, NIP, REGON, website address, information contained in public registers, bank account number and other information that you provide to us, e.g. personal data employees.
the legal basis for such data processing is Art. 6 clause 1 lit. b GDPR [1], which allows you to process personal data if it is necessary to perform the contract or take steps to conclude the contract, but also art. 6 clause 1 lit. f GDPR (i.e. the legitimate interest of the data controller) in the case of processing personal data of persons other than the other party to the future contract, e.g. persons acting on behalf of the contractor.
B. in order to conclude and perform the contract, i.e. the provision of services, we process the following personal data:
Name and surname, company name, registered office, correspondence address, e-mail address, telephone number, NIP, REGON, website address, information contained in public registers, bank account number and other information that you provide to us, e.g. personal data employees.
the legal basis for such data processing is Art. 6 clause 1 lit. b GDPR, which allows you to process personal data if it is necessary to perform the contract or take steps to conclude a contract between us.
C. in order to perform our legal obligations, e.g. issuing a VAT invoice, accounting documents and making tax settlements, we process the following personal data:
First and last name, company name, registered office, correspondence address, e-mail address, telephone number, NIP, REGON, website address, information contained in public registers, bank account number.
the legal basis for such data processing is Art. 6 clause 1 lit. c GDPR, which allows you to process personal data if such processing is necessary for the Administrator to fulfill his obligations under the law.
D. in order to consider matters addressed directly to the Personal Data Administrator, e.g. consideration of a complaint, we process the following personal data:
Name and surname, company name, registered office, correspondence address, e-mail address, telephone number, NIP, REGON, website address, information contained in public registers, bank account number and other information that you provide to us, e.g. personal data employees.
the legal basis for such data processing is Art. 6 clause 1 lit. b GDPR, which allows you to process personal data if it is necessary to perform the contract or take steps to conclude the contract, establish cooperation between us, but also art. 6 clause 1 lit. and the GDPR, which allows you to process personal data on the basis of voluntary consent.
E. in order to provide you with information about activities related to the implementation of the contract that connects us, we process the following personal data:
Name and surname, company name, registered office, correspondence address, e-mail address, telephone number, NIP, REGON, website address, information contained in public registers, bank account number and other information that you provide to us, e.g. personal data employees.
the legal basis for such data processing is Art. 6 clause 1 lit. a GDPR, which allows you to process personal data on the basis of voluntarily consent and art. 6 clause 1 lit. b GDPR, which allows you to process personal data if it is necessary to perform the contract or take steps to conclude a contract, establish cooperation between us.
F. in order to store unanswered offers / queries, we process the following personal data:
Name, company name, email address, phone number or other details you have provided to us;
It may happen that you decide to use our services some time after receiving an offer from us and the legal basis for such data processing is Art. 6 clause 1 lit. f GDPR, which allows you to process personal data if in this way the Administrator carries out its legitimate interest (in this case, the Administrator's interest is to enable the use of our services for a specified period without having to repeat the offer).
G. in order to administer the website (automatic saving of the following data in so-called server logs, each time you use our website www.hotelgateway.pl) we can process personal data such as:
IP address, server date and time, information about the web browser, information about the operating system;
the legal basis for such processing is data is art. 6 clause 1 lit. f GDPR, which allows you to process personal data if in this way the Administrator carries out its legitimate interest (in this case the Administrator's interest is to be able to administer the website. HOW TO IMPLEMENT THE RIGHT TO WITHDRAW THE CONSENT?

  1. If the processing of personal data is based on your consent, you can withdraw this consent at any time - at your discretion.
  2. If you would like to withdraw your consent to the processing of personal data, it is enough to send a letter directly to the Personal Data Administrator or send an email with the note "RODO".
  3. If the processing of your personal data was based on consent, its withdrawal does not mean that the processing of personal data until that time was illegal. In other words, until you withdraw your consent, we have the right to process your personal data and its withdrawal does not affect the lawfulness of the current processing.

ARE WE AUTOMATED DECISION MAKING AND PROFILING?

Personal data is not processed in an automated way in the form of profiling.

WHO CAN WE TRANSFER YOUR PERSONAL DATA TO?

 

 

  1. We may transfer your data to our employees and associates, who must have access to the data in order to perform our obligations or activities on your behalf.
  2. Like most entrepreneurs, we also use the help of other entities in our activities, which often involves the need to provide personal data. Therefore, if necessary, we transfer your personal data to the following recipients:

  4. b) entities conducting payment activities (banks, payment institutions);
  5. c) entities conducting insurance activity;
  6. d) entities conducting postal and courier activities;
  7. e) entities providing us with advisory, auditing or legal, tax, accounting, HR and training assistance;
  8. f) entities conducting accommodation, event and conference activities;
  9. g) entities conducting development activities.

In addition, it may happen that, e.g. on the basis of a relevant law or decision of a competent authority, we will also have to transfer your personal data to other entities, be it public or private, such as Social Insurance Institution, Tax Office, National Tax Administration, etc. Therefore, it is extremely difficult for us to predict who can make a request to provide personal data. However, we assure you that we analyze every case of a request for personal data very carefully and very carefully so as not to accidentally pass on information to an unauthorized person.

DO WE TRANSFER YOUR PERSONAL DATA TO THIRD COUNTRIES?

We would like to kindly inform you that your personal data is transferred outside the European Economic Area in connection with our use of cloud technologies of trusted global suppliers.

HOW LONG CAN WE STORE YOUR PERSONAL DATA?

 

  1. In accordance with applicable law, we process your personal data for the time that is needed to achieve the designated purpose. After this period, your personal data will be irreversibly deleted or destroyed.
  2. Regarding individual periods of personal data processing, we kindly inform you that we process personal data for the period of:
  3. a) the duration of the contract, but also after its termination, but no longer than for a period of 5 years - in relation to personal data processed for the conclusion and performance of the contract; in relation to personal data related to compliance with tax law obligations, e.g. storage of invoices, bills;
  4. b) 2 years - in relation to personal data that was collected in connection with the submission of the offer, and at the same time the contract was not concluded immediately;
  5. c) until withdrawal of consent, effective objection or achievement of the purpose of processing - in relation to personal data processed on the basis of consent; in relation to personal data processed on the basis of the Administrator's legitimate interest or for marketing purposes;
  6. Periods in years are counted from the end of the year in which we started processing personal data to improve the process of removing or destroying personal data. Counting the deadline separately for each event would involve significant organizational and technical difficulties as well as a significant financial outlay, which is why setting one date for deleting or destroying personal data allows us to manage this process more efficiently.
  7. The right to forget: Of course, if you exercise your right to forget, these situations are considered individually.

 

 

WHAT RIGHTS DO YOU HAVE?

  • The right to access your personal data - that is, obtaining information about the purpose and method of processing your personal data and a copy of the data.
  • The right to rectify data - that is, to correct data when it is incorrect, has changed or has become outdated.
  • The right to partial or total deletion of data ("Right to be forgotten") - that is, deletion of data that is processed without reasonable legal grounds.
  • The right to limit processing - i.e. limit the processing of data only to its storage.
  • The right to transfer data - that is, obtain your personal data that you have provided to us or indicate another administrator to whom we should transfer it, if it is technically possible.
  • The right to object to personal data whose submission is voluntary - i.e. for direct marketing purposes.
  • Right to withdraw consent - you can withdraw any consent you have given at any time. Please remember that we will no longer process data for the purpose indicated by you, but until we withdraw your consent, we have the right to process your data.
